Terms & Conditions

The terms on which we accept a booking and operate a sailing.

These terms apply to every cruise charter, yacht charter and event delivered by Amigos River Cruising. Where your written proposal or invoice says something different, the proposal takes precedence.

Booking and confirmation

An enquiry is not a booking. A date is held only once we have issued a proposal, you have accepted it in writing, and the confirmation advance has reached our account. Until then the date remains available to others.

Advance and balance

A confirmation advance is payable to secure the date. The balance is due before the vessel sails, on the schedule set out in your proposal. We accept bank transfer, UPI and card payment. Corporate bookings can be invoiced with GST, and a proforma invoice can be issued for internal approvals. Taxes and statutory charges apply as prevailing on the date of sailing.

Guest numbers

Pricing is built around the guest count in your proposal. Tell us the final number by the date stated there. We cannot carry more guests than the vessel is licensed for under any circumstances, and guests beyond the confirmed count are chargeable.

Boarding and timings

Cruise sailings board at Santa Monica Jetty, Panjim; yacht charters depart from the point named in your confirmation. Boarding closes at the stated time and a vessel that is due to sail will sail. Guests who arrive late may be unable to board, and no refund is due in that case. Sailing durations are approximate and subject to river traffic and tide.

Guest conduct

The Master of the vessel has final authority on board. Guests must follow crew instructions at all times, remain within permitted areas, and refrain from sitting or climbing on railings. We may refuse boarding to, or disembark, any guest who is intoxicated to the point of risk, behaves aggressively, or endangers themselves or others; no refund is due in such cases. Alcohol is served only by our licensed bar and only to guests of legal drinking age. Smoking is permitted only in designated areas. Outside food and beverage may not be brought aboard unless agreed in writing.

Safety compliance

All vessels are licensed for passenger operations and crewed by trained, certified staff. A safety briefing runs before departure and attendance is mandatory. Life jackets are provided for every guest and must be worn when the crew instruct it. Children must be supervised by an accompanying adult throughout. Guests who are pregnant, have limited mobility or have a medical condition affected by movement at sea should tell us in advance so we can advise on the right vessel and assist with boarding.

Weather and rescheduling

Guest safety governs every sailing decision. If conditions, an authority direction or a port closure make a sailing unsafe, we will not sail. Where a sailing is cancelled by us on safety grounds, we will reschedule to a mutually agreed date at no additional charge. If no workable date can be agreed, the refund position is set out in our refund policy. Operations are reduced during the monsoon and some vessels are dry-docked for maintenance.

Substitution of vessel

If a vessel becomes unavailable through mechanical fault, survey or an authority direction, we may substitute another vessel of comparable capacity and standard from our fleet. Where no comparable vessel is available, the booking is treated as cancelled by us and refunded in full.

Cancellation by you

Cancellations must be sent in writing to sales@amigosrivercruising.com. The tiered scale that applies is set out in the refund policy, which forms part of these terms.

Liability

We accept liability for death or personal injury caused by our negligence, and for anything else that cannot lawfully be excluded. Beyond that, our total liability in connection with a booking is limited to the amount you have paid us for it. We are not liable for indirect or consequential loss, for personal belongings brought aboard, or for loss caused by a guest ignoring crew instructions. Guests are responsible for their own possessions; valuables are brought aboard at your own risk.

Third-party services

Where a proposal includes services we procure on your behalf — a specialist performer, an external photographer, ground transport — we coordinate them, but their own terms govern their performance.

Photography

We may photograph or film on board for our own records and marketing. Tell your event manager before the sailing if you would prefer that we do not, and we will not.

Force majeure

We are not liable for failure to perform caused by events beyond our reasonable control, including severe weather, cyclone or flood, fire, act of God, war or civil unrest, epidemic or pandemic, strike, port or jetty closure, restriction imposed by any government or maritime authority, or failure of public utilities. In such cases we will offer a reschedule where it is possible to do so.

Governing law

These terms are governed by the laws of India. The courts at Panaji, Goa have exclusive jurisdiction over any dispute arising from them. We would always rather resolve a complaint by talking to you first — write to sales@amigosrivercruising.com or call +91 89600 70105.
